FireMon, LLC (“FireMon” or “we”) respects your privacy and is committed to protecting it through our compliance with this policy. FireMon complies with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) as set forth by the U.S. Department of Commerce. FireMon has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. FireMon has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (“Swiss-U.S. DPF Principles”) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the applicable Principles shall govern. In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, FireMon is responsible for the processing of Personal Data it receives under the applicable DPF program and subsequently transfers to a third party acting as an agent on its behalf. FireMon may disclose Personal Data to service providers, advisors, affiliates, customer support providers, hosting providers, cloud infrastructure providers, analytics providers, communications providers, and other vendors or third parties that perform services on its behalf or support Website operations, account administration, marketing administration, customer communications, recruiting, analytics, advertising, Support Services, legal compliance, security, or other legitimate business operations. FireMon may also disclose Personal Data to business partners, resellers, event or webinar providers, advertising and analytics partners, social media platforms, government authorities, law enforcement, regulators, and other parties where necessary to comply with law, enforce rights, protect persons or property, or carry out transactions or requests you direct. FireMon complies with the DPF Principles for all onward transfers of Personal Data from the European Union, the United Kingdom, and Switzerland, including the onward transfer liability provisions. FireMon is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission with respect to its compliance with the DPF Principles. In certain situations, FireMon may be required to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. Subject to the DPF Principles, individuals may have the right to access Personal Data about them and to request correction, amendment, or deletion where that data is inaccurate or has been processed in violation of the DPF Principles.

FireMon’s User Center as a customer portal for account access, license administration, software downloads, license keys, trouble-ticket intake, customer support interactions, and related account and contract administration, as well as in connection with related website, account administration, and Support Services interactions.
Certain product- and services-specific processing, including processing relating to FireMon products, Cloud Services, Telemetry Data, Cloud Services Telemetry Data, KPI Data, and related offerings, is described in the FireMon Product and Services Privacy Notice.

Right to access Personal Data that FireMon holds about you under the applicable DPF program and, where appropriate, to request correction, amendment, or deletion of that data if it is inaccurate or processed in violation of the DPF Principles.

FireMon honors Global Privacy Control (GPC) signals and other universal opt-out mechanisms where required.

If you have a question or complaint regarding FireMon's handling of Personal Data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, or the Swiss-U.S. DPF, you should first contact FireMon at privacy@firemon.com. We will investigate and attempt to resolve complaints regarding our handling of Personal Data received under the DPF Principles.

A “Do Not Sell or Share My Personal Information” link is available for applicable users.

If a privacy complaint or dispute relating to Personal Data received by FireMon in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, or the Swiss-U.S. DPF cannot be resolved through FireMon's internal processes, FireMon has committed to cooperate with JAMS, an independent alternative dispute resolution provider based in the United States, to investigate and resolve complaints regarding our compliance with the DPF Principles at no cost to you. Under certain conditions, and as more fully described in Annex I to the DPF Principles, you may be able to invoke binding arbitration to address residual complaints not resolved by other means.

Children Under 16

Our Website is not intended for children under 16, and we do not knowingly collect information from children under 16.

Data Security and Retention

FireMon implements measures to secure all confidential information, including, but not limited to, Personal Information, from accidental loss, unauthorized access, use, alteration, and disclosure. All information you provide is stored on secure servers behind firewalls, and transactions are encrypted using SSL technology. FireMon uses identifiable Personal Data as Personal Data where needed for account access, contract administration, account administration, license administration, software downloads, license key management, trouble-ticket intake, customer support interactions, and Support Services. Where FireMon transfers Personal Data to third parties acting as agents or service providers, FireMon does so for limited and specified purposes, requires those parties to provide at least the same level of protection as required by the DPF Principles, and remains liable under the DPF Principles if such parties process Personal Data in a manner inconsistent with the DPF Principles, unless FireMon proves it is not responsible for the event giving rise to the damage.

By contrast, where FireMon processes Cloud Services Telemetry Data, Telemetry Data or KPI Data, FireMon does not use that data to identify, track, profile, monitor, target, retrieve, or report on individuals or IP addresses, except as necessary for service operation, security, troubleshooting, legal compliance, or as otherwise described in the FireMon Product and Services Privacy Notice.

FireMon retains confidential information from the Websites only for as long as it is needed to fulfill the business purposes for which it was collected or otherwise provided. Once the information is no longer required for those purposes, FireMon securely deletes, anonymizes, or otherwise disposes of it in accordance with our data-handling practices and applicable legal requirements. Retention of product- and services-specific data is further described in the FireMon Product and Services Privacy Notice.

Changes to This Policy

FireMon posts any changes to the Privacy Policy on this page with an updated revision date. Material changes may also be communicated via email or Website notices.
